Mandatory Commercial / Multifamily Residential Recycling

Man Unloading Cardboard into a Recycling BinNew regulations clarify the responsibilities in implementing mandatory commercial recycling as required by Assembly Bill 341 (Chapter 476, Statutes of 2011 [Chesbro, AB 341]). This regulation addresses recycling requirements for businesses that generate 4 cubic yards or more of commercial solid waste per week and multifamily residential dwellings with 5 or more units, regardless of the amount of waste generated.

If multifamily complexes, such as condominiums, townhomes, and mobile homes, including subdivisions operated under homeowners associations, are considered residential properties by the jurisdiction, e.g., they are on the curbside recycling collection route, then they would not be subject to the regulation as they are already provided recycling service as a part of the residential program.
